Terms of Service

1. Acceptance of Terms

By accessing or using CustomsCompass ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

CustomsCompass is a compliance automation tool designed to assist Canadian importers with:

  • HS code classification guidance
  • Landed cost calculations (duties, GST, PST)
  • Document generation for customs declarations
  • Compliance validation and error detection

Important: CustomsCompass is NOT a licensed customs broker. We provide guidance and automation tools only. You, the importer, remain ultimately responsible for all customs declarations, classifications, and payments.

3. User Responsibilities

As a user of CustomsCompass, you acknowledge and agree that:

  • You are the importer of record and bear full legal responsibility for the accuracy of your customs declarations
  • You will verify all HS codes, duty calculations, and classifications before submitting to CBSA
  • You will not use the Service for any illegal or unauthorized purpose
  • You are responsible for maintaining the security of your account credentials
  • You will comply with all applicable Canadian import laws and regulations (CBSA, CFIA, Health Canada, etc.)

4. Limitation of Liability

CustomsCompass provides guidance based on CBSA and Statistics Canada data, but we cannot guarantee the accuracy of all classifications or calculations. Therefore:

  • We are not liable for any duties, penalties, or fines imposed by CBSA or other regulatory bodies
  • We are not liable for delays, rejections, or seizures of goods at the border
  • We are not liable for any financial losses resulting from incorrect classifications or calculations
  • You agree to indemnify and hold harmless CustomsCompass from any claims arising from your use of the Service

5. Subscription and Billing

Subscription fees are billed according to your selected plan. You may cancel your subscription at any time. Refunds are provided on a case-by-case basis as per our refund policy.

6. Intellectual Property

All content, features, and functionality of CustomsCompass are owned by CustomsCompass Technologies Inc. and are protected by copyright, trademark, and other intellectual property laws.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of Canada and the province of Ontario. Any disputes shall be resolved in the courts of Ontario.
